境外追赃中我国独立民事诉讼程序研究

摘　　要：我国刑事附带民事诉讼将民事诉讼置于刑事诉讼的附属地位,使民事诉讼受制于刑事诉讼;而特别没收程序被定性为刑事程序,其重视追究犯罪嫌疑人的刑事责任、忽视民事责任。解决上述问题需要建构独立的民事诉讼程序,以明确民事诉讼类型和民事诉讼主体资格,具体内容有:刑事诉讼与民事诉讼的关系,即刑事诉讼的“无罪推定”制度对民事诉讼中证明境外资产的违法性提供了依据;刑事诉讼中证明境外资产具有非法性,可将这一刑事证据的证明力运用于民事诉讼;民事诉讼中犯罪嫌疑人退还财产,并不影响刑事诉讼中对于犯罪数额的认定。此外,在开展这项工作时,还需要与资产流入国开展国际合作,以便资产流出国作出的民事判决能得到承认与执行。In China,the civil lawsuit is put in the accessory position of the criminal procedure and the civil action is subject to the criminal procedure,while the special confiscation procedure is characterized as a criminal procedure,which attaches importance to the investigation of the criminal responsibility of the criminal suspect and ignores their civil liability.To solve the above problems,it is necessary to construct an independent civil procedure to clarify the type of civil action and the qualification of the subject of civil action.And to comb the relationship between the criminal procedure and the civil action,that is,the"presumption of innocence"system of the criminal procedure,provides the basis for proving the illegality of the foreign assets in the civil action;in the criminal procedure,it is proved that the foreign assets are illegal,and the proof force of the criminal evidence can be used in the civil action;The return of property to a criminal suspect in a civil action does not affect the determination of the amount of the crime in the criminal proceedings.It is also necessary for asset-exporting countries to cooperate with asset-importing countries,so that civil judgments made by them can be recognized and enforced.
