中印边界争端解决方法的历史回顾与效果比较

摘　　要：自1959年中印边界争端产生以来,中国政府就主张在互谅互让的基础上通过谈判协商的方式和平解决中印边界问题。但是,由于印度方面的不配合,并执意使用武力迫使中国让步,中国政府被迫使用武力维护领土主权与国家尊严。直至20世纪末印度才同意中国提出的谈判解决中印边界争端的建议。历经近四十年的边界谈判,中印两国取得了一些成果。然而,中印边界谈判具有较大的局限性,面临诸多挑战。由于中印边界问题是混合型争端,仅适用单一的国际争端解决方法难以彻底解决。为了破解中印边界谈判困境,中国政府有必要综合考虑多种因素,灵活使用多种方法,构建中印边界争端解决机制,以寻求中印双方都能接受的公平合理的中印边界争端解决方案。Since the China-India boundary dispute broke out in 1959,China has advocated for the two sides to resolve issues peacefully through consultations and negotiations conducted on the basis of mutual understanding and accommodation.Due to a lack of cooperation on the Indian side,and its willingness to use force to compel China to make concessions,the Chinese government has no choice but to adopt a forceful posture as a means of safeguarding its territorial sovereignty and national dignity.Only at the end of the 20 th Century did India finally agreed to China’s suggestion that the two sides resolve the boundary dispute through negotiations.Over a period of 40 years of boundary negotiations,China and India did achieve several“early harvest”;however many challenges remain,and the countries have found that there are limits to what can be achieved.As the China-India boundary issue is a mixed dispute,applying any of single method of international dispute settlement to achieve its resolutions is not practical.In order to unlock a solution to the dilemma that China and India face,the Chinese government needs to take a full range of issues into consideration,and to adopt a flexible and multi-faceted approach.This will enable the two states to create a reasonable mechanism for addressing the boundary dispute equitably.
