国外标准必要专利许可费计算方法对中国专利开放许可制度设计的启示

摘　　要：为了促进专利的实施和运用,《专利法修正案(草案)》新设专利开放许可制度,作为本次专利法修改的一大亮点。明确许可使用费支付方式、标准是专利权人实行开放许可的条件,但何谓明确是一个歧义颇多的争点,因此有必要对此加以研究,以增强专利开放许可制度的操作性和效率。开放许可的事前许可条件和标准必要专利的许可费标准与支付方式有诸多相似之处。本文在研究欧美等国标准必要专利许可使用费用确定标准的基础上,提出进一步完善专利开放许可事前许可制度设计的建议。In order to promote the implementation and application of patents,in the Patent Law(draft amendment),it newly establishes a patent license of right system as a major highlight of the revision of this patent law.It is clear that the license payment method and standard are the conditions for the patentee to implement the license of right.However,it is a matter of ambiguity.Therefore,it is necessary to study this to enhance the operability and efficiency of the patent system.There are many similarities between the pre-approval conditions for license of right and the license fees and payment methods for standard essential patents.On the basis of studying the criteria for determining the standard use fee for standard patents in Europe and the United States,the article puts forward suggestions for further improving the conditions for pre-approval conditions for license of right.
