摘　　要：21世纪中外行政程序法发展的情况有很大差别。美国、欧盟的多数成员国乃至日本等国家在20世纪(初期、中期或后期)就制定了比较完善的行政程序法法典,所以在21世纪主要是修改和进一步完善,以及通过法院判例确立有关实施规则、原则的问题。中国在20世纪前期和中期,行政程序法基本处于空白状态,改革开放以后才开始建立法制,21世纪行政程序法有了较大发展。尽管到现在为止还没有制定出统一的行政程序法典,但已有越来越多的行政程序法单行法和地方行政程序规章出台。欧盟由于是一个超国家组织,制定统一行政程序法典的任务非常艰巨,至今未出台正式的官方行政程序法典。不过,由学界草拟的《欧盟行政程序模范规则》已于2014年完成,开始向制定统一行政程序法典的目标迈进。There are great differences in the development of administrative procedure law between China and foreign countries in the 21 st century. In the 20 th century, the United States, most member states of the European Union and even Japan have formulated relatively perfect codes of administrative procedure law. Therefore, the main task of these countries is to revise and improve the codes, and to establish relevant rules und principles of implementation through court precedents. In the early and middle of the 20 th century, China’s administrative procedure law was basically blank. It was only after the reform and opening-up that the legal system was established. In the 21 st century, the administrative procedure law has made great progress. Although we have not formulated unified administrative procedure code so far, more and more separate administrative procedure laws and local administrative procedure laws and regulations have been promulgated. As a supranational organization, the task of formulating a unified code of administrative procedures is very arduous. So far, no official code of administrative procedure has been promulgated. However, the model rules of administrative procedure of the European union drafted by academia was completed in 2014, and the goal of formulating a unified code of administrative procedures has began to move forward.
