摘　　要：当前恐怖主义活动呈现出社会影响深远、武装程度和突发性增强等特点。相应地,与之相抗衡的反恐作战能力必须得到提升,反恐工作中警察武力应得到提升和应受到重视。我国警察使用武器的法律规定在理论上存在着一定的模糊地带,如实战中警察使用武器时暴露出来的难以操作问题,一定程度上滞后于反恐工作的现实需要。因此,在反恐背景下,修改相关警察使用武器的部分法律规定,保护警察人身安全,确立用枪原则;通过司法解释等形式,明确相关武器使用法律条款的内涵;细化民警使用武器的制度、条件和程序,在实践中建立适应反恐需求的科学管理机制和使用制度。The current terrorist activity is characterized by a social base, an armed force and a sudden increase in activity, which, in general, requires that the counter-terrorism combat capability be promoted, with the direct question of the promotion of the force of the police in the fight against terrorism and the authority of the police to use the gun. In China, there is a certain vague zone in theory that the police use weapons, and the problem that the police use weapons in actual combat is difficult to operate, which lags behind the actual combat needs of anti-terrorism work to a certain extent. Therefore, in the context of counter-terrorism, the law of the use of weapons by the relevant police is amended to protect the personal safety of the police and to establish the principle of the use of the gun. Through the form of judicial interpretation, the connotation of the legal provisions for the use of the relevant weapons should be clearly defined. The systems, conditions and procedures of the use of weapons by the police should be refined in order to establish a scientific management mechanism and a system of use to adapt to the demand for counter-terrorism.
