摘 要:近代以来中国的知识与制度体系发生了彻底转型,在此过程中使用的用西方观念"整理国故"的方法,对中国传统文化的研究起到了促进作用,但其弊端也相当明显,用"神权法"一词描述中国古代早期法律思想即是明显一例。中国的国家与法律产生方式与西方国家存在较大差异,如中国古代国家产生的地理环境和初始组织形态与西方国家迥异,因此国家的运作形式及与之伴随的政治管理方法皆有不同,这决定了用以维系中国国家统治和管理的法律思想也会与西方国家存在本质差别。厘清并突破这种概念上的"附会"之意,去伪存真,有利于我们认清民族传统文化,并以此为立足点,创造出适合本民族需要的新文明。Since the modern times, China’s knowledge and system have undergone a thorough transformation. In this process, the method of using western concept "to sort out the country" has played a positive role in the research of Chinese traditional culture, but its disadvantages are also quite obvious. It is a clear example that the term "theocratic law" is used to describe the early legal thoughts in ancient China. There are great differences between the state law in China and the western countries. For example, the geographical environment and initial organizational form of the ancient Chinese are very different from those of the western countries, so the operation form of the country and the accompanying political management methods are different, which determines that the legal thought used to maintain the rule and management of the Chinese state will also be essentially different from that of the western countries. To clarify and break through the meaning of "strained interpretation" in this concept and to distinguish false things and retain the real things are helpful for us to recognize the national traditional culture and take it as a foothold to create a new civilization suitable for the needs of our own nation.
