民族地区生态环保村规民约的作用机理及其实证分析

摘　　要：生态环保村规民约是民族地区生态环保机制的重要组成部分,对于解决民族地区的生态环境问题具有独特价值。民族地区村规民约的生态环保价值源于民族地区特殊的自然和人文环境,并依托与国家法律政策、民族自治立法、少数民族习惯法之间的关系来实现。贵州黔东南苗族和侗族的实例说明,民族地区生态环保村规民约已起到了提高生态环保效率,延续传统生态文化的作用,但因其简陋性与含糊性,存在着与国家制定法之间一定的矛盾冲突。提升民族地区生态环保村规民约的作用,需要在国家和地方的政策法规中强化村规民约的作用地位,完善村规民约的生态环保内容与实施机制,协调村规民约与国家法律政策之间的关系。As an important part of the mechanism of ecological environmental protection in ethnic areas, the village rules and regulations on ecological environmental protection have unique value for solving the ecological environmental problems in ethnic areas. The value of the village rules and regulations is determined by the special natural and human environment in ethnic minority areas,and is realized through its relationship with the national law,the national autonomy legislation,and the ethnic minority customary law. Examples of the Miao and Dong in the Southeast of Guizhou province has been illustrated that the village rules and regulations on the village ecological environment in ethnic areas has played a unique role in the improvement efficiency of ecological environmental protection, the continuation of traditional ecological culture, but there is a defects of simplicity and vagueness, a contradiction and conflict between the village rules and regulations and the state laws. In order to further play the role of the village of ecological environmental protection in ethnic minority areas, we need to ascend the role position of the village rules and regulations in the national and local policies and regulations,improve its contents and implementation mechanism, and coordinate its relationship with the state law policy.
