河长制推行中法律问题探讨

摘　　要：我国的水资源总量丰富,伴着经济、社会的发展,河湖的污染日益加重,使得水资源污染、水生态系统破坏、河湖的生态环境问题日益加剧。基于此,河长制这一独具中国特色的河湖管理制度便应运而生,为解决我国当下的水生态环境问题而设计。然而,另一方面,河长制仍处于初级探索阶段,在具体的制度设计和实施中仍然存在许多的问题,针对于当前“河长制”推行中存在的法律问题,找出当下河长制推行中的相关问题,并根据我国河长制实施的立法现状,提出河长制推行中发展完善的相关构想。The total amount of water resources in China is abundant.With the development of economy and society,the pollution of rivers and lakes in China is increasing,which makes the pollution of water resources,the destruction of water ecosystem,and ecological problems of rivers and lakes become increasingly intensified.Based on this,the river chief system,a river and lake management system with unique Chinese characteristics emerged at the historic moment and was designed to solve the current problem of water ecological environment in China.However,on the other hand,the river chief system is still in the primary exploration stage.There are still many problems in the specific system design and implementation.In view of the legal problems existing in the current implementation of the“river chief system”,this paper finds out the relevant problems in the implementation of the river chief system,and puts forward some ideas about the development and perfection in the implementation of the river chief system according to the current legislative situation of the implementation of the river chief system in China.
