论国民政府时期司法党化背景下的司法独立

摘　　要：司法独立是一个老生常谈的话题,在不同历史时期其内涵有所不同,本文探讨民国时期司法党化背景下司法独立的形成与发展。国民政府时期司法独立的概念主要是从司法党化的内涵延伸出来的具体要求,然而司法党化与司法独立之间又存在着区别与联系。区别在于司法党化会破坏司法机关独立行使司法审判权意义上的司法独立;党化之后的司法权受到党权的领导,存在党权过度干预司法的可能性。其联系一是在时间维度上,司法党化与司法独立的建设有一定的重合;二是司法党化是争取司法主权独立运动的延伸;三是司法机关行使独立审判权的司法独立与司法党化相结合是国家党政一体的必然要求。事实上,司法党化和司法独立本就是一对矛盾体,不同时期的政策会导致两者的关系发生变化。Judicial independence is a platitude and the connotation of judicial independence in different historical periods is different.This paper explores the formation and development of judicial independence in the period of the Republic of China.The concept of judicial independence in the period of the national government is mainly the concrete requirement extended by the connotation of"judicial party-ization".However,there are differences and relations between judicial party-ization and judicial independence.The difference between the two is that judicial party-ization will undermine judicial independence in the sense that judicial organs independently exercise judicial power.The judicial power after party-ization is under the leadership of party power.The connection between the two lies in:one is in the time dimension,the judicial party and the judicial independence construction have certain coincidence.Secondly,the judicial party-ization is the extension of the movement for judicial sovereignty and independence.Thirdly,the independence of the judicial organs to make the judicial independence of the judicial power and the combination of judicial party-building is the inevitable requirement of the party-government integration of the country.As a matter of fact,judicial party-ization and judicial independence are contradictory bodies,and the relationship between them changes due to the policies in different periods.
