群体性事件处置的法治思考——以海南省为例

摘　　要：近年来,海南省在全面深化改革开放过程中,因土地征用、房屋拆迁、环境污染而引发的群体性事件时有发生,一定程度上影响了社会的和谐稳定。本文认为,坚持依法处置、人权保障、生态保护、源头治理、司法最终解决等原则,在借鉴国外群体性事件处置经验的基础上,从事前处置、事中处置、事后处置三个阶段入手,建立全面的、系统的、多层次的预防、控制、处置法治体系,是海南省群体性事件处置标本兼治的良方。In recent years,in the process of deepening the reform and opening up in an all-round way in Hainan Province,group incidents caused by land acquisition,house demolition and environmental pollution have occurred from time to time,which to a certain extent affected the social harmony and stability.This paper holds that it is a group event in Hainan Province to establish a comprehensive,systematic and multi-level legal system of prevention,control and disposal by adhering to the principles of disposal according to law,human rights protection,ecological protection,source control,and judicial final settlement,based on the mature experience of foreign group event disposal,and starting from the three stages of pre disposal,in-process disposal and post disposal A good way to treat both the symptoms and the symptoms.
