摘　　要：目的肉毒毒素的临床安全性和治疗效果(包括医疗及美容领域)已被越来越多的广大消费者所认知和接受,市场容量不断扩大。但目前中国肉毒毒素流通领域中存在着大量非法肉毒毒素产品。我们将从另一个角度来展示肉毒素产品的市场现状,以此来建议我们的监管部门加大力度对这市场的整治规范。方法通过对中国裁判文书网采集回顾2013-2018年以来对非法肉毒毒素的审判案件进行分析。结果全国各省及城市对肉毒毒素案件的查处审判及媒体不断报道的各类相关事件说明了非法肉毒毒素市场危害的严重性。结论揭示中国肉毒毒素市场的现实状况,建议国家市场监督管理总局从市场合规及国家安全层面进一步加强对肉毒毒素产品的监督管理。Objective With the clinical safety and therapeutic effects of botulinum toxin(BoNT)recognized and accepted by more and more consumers(including medical and cosmetic fields),the market capacity of BoNT has been expanding.However,there are a large number of illegal BoNT products in the field of Chinese BoNT application.In order to make our regulatory authorities intensify efforts to rectify this market,to make medical practitioners use legal products in the legal occasion,to make medical organization compliantly purchases qualified products and to make consumers go to the legal medical institutions for consumption,we would show the market status of BoNT products from another angle.Methods Trial cases of illegal BoNT products during May,2013 to May,2018 are collected and analyzed based on China Judgement Online.Result With the investigation of illegal BoNT cases and various related incidents reported by the media in various provinces and cities in the country,the seriousness of the harm of the illegal botulinum toxin market is illustrated.Conclusion Reveal of the status of BoNT market would strengthen supervision and management of illegal BoNT products at the national security level.
