摘  要:航次租船合同包含的货物运输合同与提单证明的运输合同是两种不同类别的合同,前者遵循合同自由原则,后者则是限制合同自由。两种完全独立的、不同种类的合同,不可能成为一般规定与特别规定的关系。中国海商法将航次租船合同认定为是提单证明的运输合同的特别规定,给司法实践造成了不必要的困扰。可行的解决途径是:明确规定《海商法》第四章的适用范围,排除对租船合同的适用。The contract of affreightment contained in voyage charter party is different from the contract of carriage evidenced by B/L.Charter party follows the principle of freedom of contract,while the contract of carriage evidenced by B/L should restrict the freedom of contract,especially when there is no written contract but transport document to be an evidence of contract.It is obliviously that both kinds of contract are individually existed not what between a generally provision and special provision.Chinese Maritime Code regards voyage charter party as a special provision of the contract of carriage evidenced by B/L,which has caused unnecessary troubles in judicial practice.This paper suggests to specify the scope of the application of Chapter IV of Chinese Maritime Code and excludes its application to charter party.
