我国台湾地区法院档案的公开与借鉴——以法庭录音录影光碟交付制度为视角

摘　　要：作为法院档案公开的一部分,我国台湾地区法庭录音录影档案主要通过光碟交付制度进行公开。此制度确立于2003年,十几年来历经多次修正。2016年最新修法确立了对于法庭录音录影光碟交付申请除审判公开例外情形均应许可的宽松标准。法庭录音录影光碟交付制度涉及当事人诉讼权保障、隐私权保护及司法公开之间的利益衡量,修法过程中交付肯定说和否定说交锋不断。由于文化同源,我国台湾地区较为完善的法庭录音录影光碟交付制度对于大陆地区具有诸多可借鉴之处。As part of the openness of court archives,the audio and video archives of Taiwan’s courts are mainly made public through the discs delivery system.This system of Audio and video recording discs in courts of Taiwan was established in 2003 and has been modified several times during more than ten years.The latest amendments in 2016 established loose standards for the delivery system of audio and video recording discs applications in addition to the publication of the trial.The court's audio and video recording discs delivery system involves the measurement of the interests of the parties'right to sue,the protection of privacy and the openness of the judiciary.The affirmative and negated deliveries in the course of amendments are constantly confronted.Due to cultural homology,the relatively perfect the audio and video recording discs delivery system for courts in the Taiwan region deserves reference from the mainland.
