论自治州“二元”立法监督机制  

On the "Double" Legislation Supervision Mechanism of Autonomous Prefecture

摘　　要：自治州存在一般地方立法与自治立法的“二元”立法监督机制。自治州一般地方立法监督以“不抵触上位法”(即“合法性”问题)为核心,自治州自治立法监督应当区别存在“变通规定上位法”和没有“变通规定上位法”两种情形,其中,前者应当进一步区别文本中的“变通规定”条款和非“变通规定”条款;对于不存在变通规定上位法的自治立法,与一般地方立法监督一样,遵循的同样是“不抵触上位法”原则;对于存在变通规定上位法的自治立法,对其中的非变通规定条文,立法监督仍然应当遵循“不抵触上位法”原则——只有其中的变通规定条文,立法监督才是遵循“不得违背《立法法》第97条列举的情形”的原则。The autonomous prefecture has a"dualistic"legislative supervision mechanism for general local legislation and autonomous legislation;the general local legislative supervision of the autonomous prefecture is centered on the"noncompliance with the superior law";The autonomous prefecture's legislative supervision shall be distinguished for those legislation which has flexible regulations or does not have.The former shall further be distinguished between the flexible-regulation provisions and non-flexible-regulation provisions in a same legislative text.For the non-flexibleregulation provisions or non-flexible-regulation legislation,like the general local legislative supervision,the principle of"not contradicting the upper law"shall be followed.Only for the flexible-regulation provisions,the legislative supervision is to follow the principle of"not to violate listed in Article 97 of the Legislative Law".
