府际关系视野下的民族自治地方自治立法

摘　　要：民族自治地方自治法规制定中的府际关系是自治权的反映与透视。自治立法由于自治权因素以及不同于一般性地方立法的程序规制,其中的府际关系主体呈现出多元多向互动格局,在自治立法中承担着不同的角色,发挥着不同的功能。中央与民族自治地方、上级国家机关与下级民族自治地方之间的权力利益关系,对自治立法内容构成制约,条块体制致使上级行政机关对下级自治地方自治立法具有重要影响。完善党领导自治立法的体制机制,构建自治立法过程中的协调府际关系,充分发挥自治地方人大在自治立法中的主导地位,建立自治立法的府际协同机制,有利于消弭府际矛盾与冲突,完善民族自治地方自治立法。The intergovernmental relations appeared during the enacting process of autonomous regulations in ethnic autonomous areas are a reflection of the right of self-government.Due to the factors of autonomous right and the special procedural regulation,the autonomous legislation is different from the general local legislation.The body of intergovernmental relations present a pluralistic and multiple directional dynamic pattern and play different roles and functions in the autonomous legislation.The power and interest relations between the central government and ethnic autonomous areas,the higher state organs and the lower ethnic autonomous areas restrict the content of the autonomous legislation.Because of the existence of Tiao-kuai relation,the higher administrative organ has an important influence on the autonomous legislation of the lower autonomous areas.It is helpful for the prevention of intergovernmental conflicts and improvement of the autonomous legislation of ethnic autonomous areas to perfect the system of Chinese Communist Party’s leadership over autonomous legislation,construct harmonious intergovernmental relations in the enacting process of autonomous legislation,let the people’s congress play the leading role in the legislative process,and establish an intergovernmental coordination mechanism of autonomous legislation.
