“软袭警”行为对民警造成“柔性”不法侵害的问题与对策研究

摘　　要：“软袭警”行为中的“柔性”不法侵害与暴力侵害相比,具有伤害程度大、传播速度快、蔓延范围广、侵害手段隐蔽性强等特点,其社会危害性在某种程度上远甚于暴力侵害。因此,公安民警在正当执法过程中针对“柔性”不法侵害,不能采取过度纵容的态度,而应结合工作实际,从个人、网络和机制着手,加大惩治处罚力度,加强民警维权保障。Compared with violent assaults,the“flexible”infringement in the“soft assaults on police”cases is characterized by greater damage,rapid and wide spread,and hidden means.The social harm to some extent is even greater than that of the violence.Therefore,in the process of proper law enforcement,the public security police cannot take excessively lenient attitudes towards“flexible”infringement.Instead,based on the actual work efforts shall be made to change the individuals,network and mechanism,impose severe punishment,strengthen the protection of civilian police rights so as to change the current embarrassing situation.
