全国性单项运动协会社团法人实体化改革趋向与推进的法治化路径研究

摘　　要：全国性单项运动协会改革必须坚持“独立社团法人实体”的目标取向。构筑“政社”新型关系,需要将单项运动协会定位于均衡公序与私序的公共法人组织,并借由法人治理结构架构、国有资产分离与调配、权利义务的明晰,构建“权责明确、制衡有效、产权清晰、依法自治”的现代独立化法人自治组织。当前改革的实践,已进入攻坚阶段的抵触期,体制机制的增量改革已到临界点,需要通过制度的增量改革突破路径的“锁定”状态。法治是单项运动协会的组织架构、管理体制、运行机制等“破旧立新”的根本保障,推动当前单项运动协会社团法人实体化改革向纵深方向发展需要法治的保障。基于“依法治体”与“体育深化改革”的现实需要,提出全国性单项运动协会社团法人实体化改革与发展的法治化进路。This paper proposed that the goal of deepening the reform of individual sports associations must adhere to the "independent corporate legal entity". Establishing a modern independent legal person autonomous organization with "clear powers and responsibilities,effective checks and balances,clear property rights,and autonomy according to law"requires the individual sports associations to be positioned as a public legal person organization that balances public and private order,corporate governance structure,and the separation of state assets clarification of deployment,rights and obligations. The current reform practice has entered a tackling phase and a period of conflict,and the incremental reform of the institutional mechanism has reached a critical point,requiring the "locked"state of the incremental reform of the system to break through the path. The rule of law is the fundamental guarantee for the "smashing the old and setting up the new"of the organization structure,management system,and operating mechanism of the individual sports associations. The promotion of the current physical reform of corporate bodies of individual sports associations requires the guarantee of the rule of law. Based on the actual needs of "ruling by law"and "deepening the reform of sports",this paper proposes a legal approach to the reform and development of the corporate entity of a national single sports association.
