摘　　要：专利共享行为的性质为一种基于善观念的伦理上的捐献行为。它可以采取专利许可协议的法律形式,并包含反向许可条款;也可以采取放弃行使专利权等形式。专利共享行为对于矫正专利制度弊端、改善技术生态有所助益。预计未来它将与专利法律制度平行发展。Patent sharing behavior is a kind of donation behavior based on virtue ethics.It can adopt the legal form of patent license agreement,containing reverse license clauses.Patent sharing behavior can help to correct the drawbacks of the patent system and improve the technological ecology.It is expected to develop side by side with the legal system on patent.
