摘　　要：相对封闭区域商品和服务价格畸高的现象已经严重扰乱了正常的市场竞争秩序,侵害了消费者的合法权益,这种现象理应是我国《消费者权益保护法》、《反垄断法》等规制的对象。目前在我国对相对封闭区域畸高价格行为进行规制主要存在着畸高价格认定标准不明确,市场定价具有形式上合法性,消费者公平交易权和自由选择权外延过窄,相关市场与不公平高价认定两难等困境。应当完善相对封闭区域价格行为的相关立法,优化畸高价格认定标准,扩张解释消费者公平交易权和自由选择权,创新相关市场和不公平高价认定标准;同时,要强化对业主单位的监管责任,增强相关市场的竞争性,建立健全相关配套措施,走综合治理之路。The phenomenon of abnormally high prices of goods and services in relatively closed areas has seriously disturbed the normal order of market competition and infringed on the legitimate rights and interests of consumers. This phenomenon should be the object of regulation such as the Protection of Consumer Rights and interests Protection Law and the Anti-monopoly Law of our country. At present, there are some dilemmas in the regulation of abnormal high price behavior in relatively closed areas in our country, such as the unclear standard of abnormal high price, the formal legitimacy of market pricing, the narrow extension of consumers’ fair trading right and free choice, the dilemma of "related market" and "unfair high price". The relevant legislation on price behavior in relatively closed areas should be improved and the abnormal high price should be optimized. At the same time, it is necessary to strengthen the supervision responsibility of the owners’ units, enhance the competitiveness of the relevant markets, establish and improve the relevant supporting measures, and take the road of comprehensive governance, so as to expand the interpretation of consumers’ fair trading rights and free choice;at the same time, we should strengthen the supervision responsibility of the owners’ units, enhance the competitiveness of the relevant markets, establish and improve the relevant supporting measures, and take the road of comprehensive governance.
