摘 要:房地产行业存在着严重的暴利行为,其危害极大,不仅影响社会主义经济健康的发展,还容易引发社会矛盾、威胁社会稳定。我国现有法律政策对房地产暴利行为规制效果欠佳,导致房价屡创新高。现有调控政策失效存在多方面的原因,其中重要原因在于路径选择问题。针对控制消费者的法律政策应转向控制经营者、开发商的法律政策。在民法、经济法等第一次规范无法调整或调整失效后,刑法应该及时介入,通过将房地产暴利行为纳入刑法调整范畴,有效抑制房地产行业暴利行为,平抑房价。There are serious huge profits behaviors in the real estate industry,which do great harm to the healthy develop⁃ment of economy,and also easily lead to social contradictions and threaten social stability.Our existing laws and policies are not effective in regulating the huge profits behavior in real estate,which leads to the high housing prices.There are many rea⁃sons for the failure of existing regulatory policies,among which the important one is the path choice.The law and policy of con⁃trolling consumers should be turned to control operators and developers.After the first norms such as civil law and economic law fail to adjust,the criminal law should intervene in time.By incorporating the behavior into the scope of criminal law adjust⁃ment,the huge profits behavior of the real estate industry can be effectively suppressed and the house price can be stabilized.
