《刑法》与《监察法》在职务犯罪从宽规定上的衔接——以职务犯罪特别从宽规定的刑事立法完善为视角

摘　　要：为体现惩治与教育相结合的精神,同时也为提高反腐工作的效率,《监察法》与《刑法》分别作出了针对职务犯罪的认罪认罚从宽制度和特别从宽规定。认罪认罚从宽制度的理论定位和《监察法》相对于《刑法》的新法地位决定了《监察法》中认罪认罚从宽制度规定的贯彻落实需要《刑法》中职务犯罪特别从宽规定与之对接。然而,现行《刑法》中有关职务犯罪特别从宽的规定,存在适用范围有限且缺乏体系性、适用条件严苛、从宽幅度设置不当的问题,无法保障《监察法》中认罪认罚从宽规定的贯彻落实。对此,应结合《监察法》相关规定,通过立法路径,修改现行《刑法》中职务犯罪特别从宽规定的适用范围、适用条件和从宽幅度。In order to embody the spirit of combining punishment with education,and to improve the efficiency of anti-corruption work,the Supervision Law stipulates a confession and punishment system for duty crimes,and the Criminal Law has made a special stipulation.The theoretical orientation of the lenient system of confession and punishment and the new legal status of the Supervisory Law relative to the Criminal Law determine that the implementation of the lenient system of confession and punishment in the Supervisory Law requires the docking of the lenient provisions of duty crimes in the Criminal Law.However,there are some problems in the current Criminal Law,such as limited scope of application,lack of systematicness,stringent applicable conditions and improper range of leniency,which can not guarantee the implementation of the leniency of confession and punishment in the Supervisory Law.In view of this,we should amend the scope,conditions and scope of the system of special leniency of duty crimes in the current Criminal Law through the legislative path of criminal law in accordance with the relevant provisions of the Supervision Law.
