摘 要:我国的"司法行政化"问题由来已久,严重影响了审判的独立性与公开性,影响了司法体制的发展进程。本轮院庭长监督管理运行机制改革强调权力运行回归司法运行规律,充分尊重审判的独立性与公开性。在司法体制改革新时期,不仅需要依法保障院庭长审判监管权,同时院庭长也要树立新思维,改变过去"行政化"的监管理念,理顺"放权"与"监督"的关系,切实厘清审判权与审判监督权、审判管理权之间的界限。对于权力的行使方式,加强对院庭长权力的监督,遵循全程公开化、留痕化的管理模式,以便于事后追责时有据可查。China’s judicial administration has a long history,which seriously affects the independence and openness of the trial as well as the development of the judicial system. The President of the current round of supervision and management operation mechanism reform emphasizes the return of power to judicial operation,fully respecting the independence and openness of the trial.In the new era of judicial reform,it is not only necessary to guarantee the President’s right to judge and supervise according to law,but also to establish new thinking,change the regulatory concept of administerization in the past,and straighten out the relationship between decentralization and supervision to clarify the boundary between judicial power,judicial supervision and judicial administration. With regard to the way in which power is exercised,the supervision of the power of the president of the court is strengthened,and the management model of the entire process of openness and retention is followed,so that it can be documented when the responsibility is pursued afterwards.
