摘　　要：动产质权设立手续简便、费用低廉,在融资领域中有着广阔的发展空间。针对动产质权制度的研究,应当以其标的的研究为逻辑起点。通过对各国动产质权标的的立法体例的比较、构成要件异同的分析及其标的范围的探讨,明晰动产质权标的在世界范围内立法的内涵及范围,对其仍然存在争议进行探讨,有助于我们在遵循“物权法定”原则前提下,尊重当事人意思自治,拓宽标的的范围,适应市场对融资的需求。The movable property pledges are easy to set up and low in cost,and have broad development space in the field of financing.The research on the pledge system of movable property should start with the research on its subject matter.Through the comparison of the legislative styles of movable property pledges in various countries,the analysis of the similarities and differences of the constituent elements,and the discussion of the scope of the objects,the connotation and scope of the legislation of movable property pledges in the world are clarified,and their controversies are still discussed,which is helpful Under the premise of following the principle of"statutory property rights",we respect the autonomy of the parties,broaden the scope of the target,and meet the market's demand for financing.
