摘　　要：农村集体经济组织是农村土地集体所有权的行使主体,在三权分置背景下,强化农村集体经济组织建设是确保农村土地集体所有权不被虚置的重要措施。本文通过对当前形势下农村集体经济组织主体发展困境的分析,探讨在三权分置背景下农村集体经济组织信用功能、土地收储功能以及特别法人功能的构建,建议在《农村集体经济组织法》立法中将农村集体经济组织定位为受法律和政策特别保护,允许有限破产的一类特殊市场主体。Rural collective economic organizations are the main body to exercise the collective ownership of rural land.Under the background of division of the three land rights,it is an important measure to strengthen the construction of rural collective economic organizations to ensure that the collective ownership of rural land is not to be set up nominally.By analyzing the development dilemma of the main body of rural collective economic organizations,the establishment of credit,land purchase and special juridical person functions of rural collective economic organizations is discussed under the background of division of the three land rights.We suggest that in legislation of organic law of rural collective economy rural collective economic organizations be positioned as special main market players which are protected to have permission of finite-time ruin by law and policy.
