摘 要:农地发展权是农民作为主体通过农地使用性质的变更或集约化生产实现农地增值发展的权利。农地发展权是以开发农地为价值取向的土地衍生权利,是一种潜在的、动态的财产权利。农地发展权源于农地所有权,其法律属性宜定位为私权;农地发展权具有用益物权、独立的财产权、客体发展权、无形的创新性产权等多元法律性质。就农地发展权之权利结构而言,其权利主体应是混合主体,是农民集体和农民个体的有机统一。农地潜能及其开发分别应为农地发展权的权利客体和权利内容。The right of farmland development is the land right enjoyed by the farmers to realize the value-added development of farmland through the change of the nature of farmland use or intensive production.The right of farmland development is a derivative land right with developing the farmland as the value orientation which is a potential and dynamic property right.The right of farmland development originates from the farmland ownership and its legal nature should be defined as a private right.At the same time the right of farmland development has multiple legal properties such as usufructuary right independent property right object development right intangible innovative property right.As far as the structure of the right of farmland development is concerned the right subject should be a mixture which is the organic unity of the collective and the individual of farmers.The potential of farmland and its development should be the object and content of the farmland right respectively.
