摘　　要：高校教育惩戒权是以教育为目的的纪律处分。教育契约和大学自治是教育惩戒权的重要理论来源。高校行使教育惩戒权必须基于清楚的事实,符合教育目的,遵循正当程序,保障学生基本权利。The disciplinary power of colleges and universities is disciplinary action which aims at education.Education contract and university autonomy are important theoretical sources of disciplinary power.The execution of disciplinary power in colleges and universities must be based on clear facts,conform to educational purposes,follow due process and safeguard students’basic rights.
