卫生行政处罚案件过程性审查探讨

摘　　要：当前卫生行政部门对卫生行政处罚案件的法制审核,一般只适用于重大卫生行政处罚案件,而一般卫生行政处罚案件则未必经过了这种内部约束。实践中,一般卫生行政处罚案件违法甚至在司法上败诉的情形也屡见不鲜。倡导卫生监督系统内部对本机构办理的一般卫生行政处罚案件开展过程性审查,是全面提升卫生行政处罚案件查办质量、防范执法风险、适应卫生依法行政理念发展的必然趋势。从审查原则、审查思路、审查标准、审查内容、审查方法等方面,对卫生行政处罚案件办理过程性审查问题进行探讨。At present,the legal examination and verification of health administrative punishment cases by health administrative organs are generally only applicable to major health administrative punishment,while the internal constraints of such legal examination and verification may not necessarily be applied to general health administrative punishment cases.In practice,it is common for the cases of general health administrative punishment to break the law or even lose in the judicial proceedings.It is an inevitable trend to improve the quality of investigation and handling of health administrative punishment cases,prevent law enforcement risks and adapt to the development of health administration by law.In this paper,the review principle,review ideas,review standards,review content,review methods and other aspects of the health administrative punishment case handling process review issues were discussed.
