组织论文买卖、代写行为入刑必要性研究

摘　　要：论文买卖、代写已经形成了完整的黑色产业链,严重危害着科研环境,对中介机构及其组织行为亟需进行严厉的惩治。由于行政制裁措施力度不足,行政监管难以涵盖诸多参与经营的市场主体。民事制裁措施基于当事人的合意,具有极大的局限性。刑罚应当成为打击组织论文买卖、代写的强有力手段。而现有的非法经营罪、侵犯著作权罪、合同诈骗罪、诈骗罪、组织考试作弊罪等罪名均无法有效覆盖该行为,应当设立独立的组织买卖、代写论文罪进行规制。Purchase,sales or ghostwriting of theses has already formed an integral dark industry chain,which severely threaten research environment.The intermediaries and their organizing activities shall be penalised and sanctioned.However,administrative sanctions do not punish academic misconduct adequately.Administrative supervision cannot cover many market participants.Civil sanctions play limit function due to the restriction from consent of the parties.Therefore>penalty shall be forceful means against theses purchase,sales or ghostwriting.Crime of illegal business operation,copyright infringement,contract fraud,fraud and organizing cheating in examinations at present are not able to crack down these illegal conducts.It is necessary to establish a separate crime of organizing purchase,sales and ghostwriting of theses to punish these conducts.
