论跨文化社会治理法治化中的立法需求——以文化治理为重心

摘　　要：在全面和真实的法治之中,行政相对人的社会角色及其文化属性不应是被遮蔽的,而是必须正视并因此使得行政法律关系的具体内容与形态具有更加实质的正当性和针对性。在深度开放中,在华外籍人员的商贸、生活、社交等诸多方面的需要不断充实和提高,持续、广泛和深刻地与在地社会之间形成对接关系,其中文化疏离、互动、融合或差异、区隔等促使社会治理和政府管理呈现出愈发显著的跨文化特质。由此,跨文化社会治理中必须充分注重文化差异的主客观因素,更加重视治理的协同性、互适性,更加重视文化治理的包容、涵养、沟通与引导功能及相应政府文化行政给付等职能方式。要实现跨文化社会治理法治化,首要的是对其立法的价值需求、目标需求、制度需求与结构需求等要素进行深入提取、科学判断和有效回应。In the comprehensive and real rule of law, the social role and cultural attribute of the administrative counterpart should not be covered, but must be faced up to, therefore making the specific content and form of administrative legal relationship more substantive legitimacy and pertinence. In the deep opening-up, the needs of business, life, social interaction and many other aspects of expatriates in China have been continuously enriched and improved, and a continuous, extensive and profound docking relationship has been formed with the local society, among which cultural alienation, interaction, integration or difference, and separation have contributed to the increasingly significant cross-cultural characteristics of social governance and government management. Therefore, in the cross-cultural social governance we must pay full attention to the subjective and objective factors of cultural differences, and more attention to the coordination and mutual adaptability of governance, the inclusiveness, self-restraint, communication and guidance functions of cultural governance, and the corresponding government cultural administrative benefits. In order to realize the legalization of cross-cultural social governance, the first thing is to grasp, judge scientifically and to respond effectively to the value demand, goal demand, system demand and structure demand of its legislation.
