改革开放以来党内法规建设的基本经验——以党内条例制定和修改为例

摘　　要：改革开放以来,党内条例建设经历了三个阶段:以问题为导向的急用先立阶段;初步规范化和体系化阶段;规范化和科学化阶段。近四十年来,党内条例建设在管党治党和加强党的建设方面取得了巨大成绩,获得了宝贵的经验。这些经验包括:在条例的制定目的和依据方面,要坚持以加强党的建设为目的,以党章为根本依据;在条例内容定位方面,要理顺条例的上下左右关系,主要是条例与其他党内法规之间、条例与国家法律法规之间的关系;在条例顶层设计上,要处理好体系的完备性和急用先立的关系;在条例制定过程方面,要处理好党内民主与集中的关系,加强立法民主和开门立法的关系;在立法技术方面,要重视条例自身的科学性和规范性。Since the reform and opening up,the construction of inner-Party statutes has gone through three stages:the problem-oriented stage of enactment for urgent use,the stage of preliminary standardization and systematization,and the stage of standardization and scientization.Over the past three decades,great achievements and valuable experiences have been gained in regulating and governing the Party and in strengthening party building.These experiences include:in the purpose of enacting and basis of the statutes,we must adhere to the purpose of party building and the Party Constitution as the overriding criterion;in terms of the contents of the statutes,the horizontal and longitudinal relationship of the ordinances,mainly the relationship between the ordinances and other intra-Party regulations and between the intra-Party statutes and national laws and regulations,should be straightened out;in the top-level design of statutes,we should deal with the relationship between the completeness of the system and the provisional enactment for urgent use;in the process of formulating statutes,the relationship between intra-Party democracy and centralism should be properly handled,and the relationship between legislative democracy and open-door legislation should be strengthened;and in the aspect of legislation technology,we should attach importance to the scientific nature and standardization of intra-Party statutes.
