摘　　要：南海蕴藏着丰富的油气资源,但该区域的资源开采因政治原因长期处于无序和低效状态。为维护在南海的主权及其他合法权益,实现能源多元化战略,保障能源安全,中国作为南海区域的大国有必要通过对话与合作来强化在南海区域油气资源开发活动的参与程度与话语权。自中国能源公司通过国际投资进入南海以来,与印度尼西亚之间的合作是中国-东盟框架下南海能源合作的典范。印度尼西亚在油气领域的对外合作以产品分成合同作为典型的法律样本,这也是全球范围内油气合作的典型样本,其主要呈现出较强的灵活性、成熟性以及资源民族主义烙印等特征,这些特征对于中国-东盟在南海的油气合作具有重要的指示意义。The South China Sea is rich in oil and gas resources,but the exploitation of oil and gas resources in the region has long been in a state of disorder and inefficiency for political reasons.In order to safeguard China’s sovereignty and other legitimate rights and interests in the South China Sea,realize energy diversification strategies,and ensure energy security,China,as a big country in the South China Sea region,needs to strengthen the participation and voice of oil and gas resources development activities in the South China Sea region through dialogue and cooperation.Since the Chinese energy company entered the South China Sea through international investment,the cooperation between China and Indonesia is a model of energy cooperation in the South China Sea under the China-ASEAN framework.Currently,it is mainly carried out through international investment.Indonesia’s external cooperation in the oil and gas sector uses a product sharing contract as a typical legal sample,which is also a typical sample on a global scale of this field and mainly exhibits strong flexibility,maturity and resource nationalism.These characteristics have an important guiding significance for China-ASEAN oil and gas cooperation in the South China Sea.
