摘  要:保护作品完整权是我国《著作权法》所规定的作品精神权利的核心,赋予作者保护作品不受他人歪曲、篡改的权利。然而,随着时代发展,网络上关于作品的二次创作形式和内容的多样化使相关法律规定捉襟见肘,保护作品完整权的内涵也应与时俱进。以“谷阿莫”系列的网络短视频为例,对戏仿作品是否侵犯保护作品完整权展开讨论,提出了在网络环境中对于保护作品完整权的完善建议:首先要区分“歪曲、篡改”行为和合理的修改行为,其次要确定客观主义标准的侵权规则,再次需要统一对于影响原作者声誉的判断标准。The protection of the right of integrity is the core of the spiritual rights of works as stipulated in China’s Copyright Law,giving authors the right to protect their works from distortion and tampering.However,with the development of the times,the diversification of the second creation form and content of the works on the Internet has made the relevant legal provisions stretched,and the connotation of protecting the integrity of the works should also keep pace with the times.Taking the short video of the“Gu Amo”Series as an example,this paper discusses whether the parody works infringe the right to protect the integrity of the works,and puts forward suggestions for perfecting the right of the integrity in the network environment.First of all,it is to distinguish between“distorting and tampering behaviors”and“reasonable modification behaviors”;secondly,to determine the infringement rules of the objectivist standard;thirdly,to unify the criteria for judging the impacts on the reputation of the original author.
