行政执法与刑事司法衔接的二元格局及其法治后果——以食品药品监管领域的经验为例

摘　　要：在食品药品监管领域,执法部门和司法机关之间存在两种迥异的互动关系,这种关系模式促成了行政执法与刑事司法衔接实践的合作-对立二元格局。部门间的组织合作体现为食品药品监管部门和公安机关的“案前”联合,而部门间的组织对立则表现为人民检察院与执法部门的结构性冲突。上述二元格局的形成具有深刻的组织原因。食品药品监管部门和公安机关在目标责任制下容易达成共识,它们为完成相近的目标任务建立起紧密的合作关系。人民检察院承担法律监督职能却缺乏监督手段,在监督行政执法与刑事司法衔接过程中容易与监督对象形成紧张关系。食品药品监管领域行政执法与刑事司法衔接的二元格局产生了复杂的法治后果,形成了司法扩张和执法失范,并造成了法律监督失灵。研究表明,法律的运行会受到行政和司法体制机制的直接影响,体制中的跨部门合作是法律实施的重要保障。In the field of food and drug administration,there are two different interactions between law-enforcing department and judicial authorities.It has promoted the cooperation between administrative law enforcement and criminal judicature.The organizational cooperation between departments is embodied in the“before case”cooperation between food and drug administration departments and public security organs,and the organizational opposition between departments is reflected in the structural conflict between the people’s procuratorate and the law-enforcing department.The formation of the above dualistic structure has profound organizational reasons.Food and drug administration departments and public security organs are easy to reach a consensus under the target-oriented responsibility system,and they have established a close cooperative relationship to accomplish the same goals.The people’s procuratorates shall assume the functions of legal supervision but lack the methods of supervision,which is easy to form tension relationship with the object of supervision in the process of supervising administrative law enforcement and criminal justice.The dualistic structure of administrative law enforcement and criminal justice in the field of food and drug administration has produced complex legal consequences,which formed the judicial expansion and law enforcement irregularities,and caused the failure of legal supervision.Studies have shown that law enforcement is affected by the structure of administrative and judicial systems,which needs to be guaranteed by effective organizational cooperation between law enforcement and judicial departments.
