“三权分置”背景下农户宅基地使用权流转的改革思考

摘　　要：宅基地“三权分置”使得现有的使用权剥离了原法律框架所赋予的身份属性,解决了宅基地使用权难以放活的制度困境。通过比较“三权分置”与“二权分置”下农户宅基地使用权,可以清晰看到“三权分置”下宅基地使用权流转范围与流转方式发生了很大变化,宅基地资产性功能明显增强。在放活宅基地使用权实践中,因法律制度制约,全国宅基地试点县使用权改革仍较谨慎。为此,需要更有针对性的措施推动宅基地使用权流转,通过确权明确权利界线、出台促进宅基地使用权流转规范性制度、以市场为多余建设用地(其中宅基地占据大部分)资源配置基础、将多余宅基地资源转为集体经营性建设用地、调整对宅基地使用权指标流转管控等。The identity attribute of the homestead use right in the“three-power division”has been stripped,the institutional dilemma has been solved.Through the comparison of the use rights in the"three-power division"and"two-power division",it can be clearly seen that the transfer scope and the transfer mode have changed greatly,and the asset function of the homestead is obvious.In the practice of releasing the homestead use right,the pilot county reform is still cautious due to the restriction of the legal system.To this end,more targeted measures are needed to promote the use right transfer,including defining the right boundary through the confirmation of power,introducing a normative system for promoting the homestead use right transfer,and using the market as allocating the redundant construction land(most of the homestead land),conversing the surplus homestead resources into collectively-operated construction land,controlling the transfer of the homestead use right indexes.
