《专利法》修正背景下专利犯罪的刑法规制调整

摘　　要：在专利权保护需求持续增强的背景下,《专利法》启动了第四次修正,拟增加假冒专利行为的罚款数额,增设对专利侵权行为的惩罚性赔偿制度等措施,以期回应专利权保护实践。从法秩序统一和法律衔接的角度来看,上述拟修正的内容会使刑法与修正后的《专利法》在惩罚力度上的衔接脱节、在惩罚门槛上的衔接错位以及在惩治范围上的衔接断层。为了弥合两法之间的冲突,完善专利权法律保护的规范体系,刑法应当在规制上做出相应的调整。具体而言,应当提高假冒专利罪的法定刑设置,加大打击力度;调高假冒专利罪的入罪标准,提升打击精度;将严重的专利侵权行为作入罪处理,拓宽保护面积;在司法实践当中转变理念和方式,强化保护效果。Under the background of the continuous enhancement of the demand for patent protection,Patent Law initiated the fourth amendment,intending to increase the amount of fines for counterfeiting patents,and add a punitive damages system for patent infringements in order to respond to protection practices of patent rights.From the perspective of the unification of the legal order and the convergence of the law,the above-mentioned proposed amendments will make the criminal law and the revised Patent Law disjoint in the punishment,the mismatch in the punishment threshold and the convergence in the scope of punishment.In order to bridge the conflicts between the two laws and improve the normative system of legal protection of patent rights,the criminal law should make corresponding adjustments in regulation.Specifically,it is necessary to increase the statutory penalty setting for the crime of counterfeiting patents,increase the intensity of crackdowns;increase the sin standards for crimes of counterfeiting patents,and improve the accuracy of strikes;treat serious patent infringements as sin and broaden the protection area;change the concept and method in judicial practice and strengthen the protection effect.
