摘　　要：法学名词是法律概念的指称,法律术语的统一与规范是法律学科发展水平的标志,法律作为一种规则普遍适用于每一个社会成员,统一性和规范性是调整人们行为功能的必然要求。因此,法学名词的统一和规范具有比其他学科更重要的研究价值,通过立法来促进保障法律术语的规范是法治建设的必然要求。文章重点研究法学名词规范化立法的背景与法理基础,为法学名词规范化立法提供更加坚实的理论基础与可行的操作方法。Chinese terms in law refers to legal concept.The unification and standardization of legal terminology is the symbol of the development level of legal discipline.Law as a rule is universally applicable to every member of society.Unity and standardization are the inevitable requirements for adjusting people's behavioral functions.Therefore,the unification and standardization of Chinese terms in law has more important research value than other disciplines.It is an inevitable requirement for the rule of law to promote the regulation of legal terminology through legislation.This paper focuses on the background and legal basis of the legalization of Chinese terms in law,and provide a more solid theoretical basis and feasible operational methods for the legalization of Chinese terms in law.
