摘　　要：非洲区域经济组织作为实现非洲经济共同体的支柱,在非洲一体化进程中扮演着重要角色,但非洲许多区域经济组织间缺乏有效统筹和整合,成员国身份重叠现象导致制度的重合与冲突。成员身份重叠现象对经济一体化的发展具有一定的积极作用,然而它的负面影响更应引起重视。这种负面影响在阻碍区域经济一体化上表现得尤为突出,特别是带来多重义务负担沉重、区域司法机构间管辖权冲突、区域经贸制度间法律适用冲突等问题。当下,非洲国家迫切需要探寻消解非洲区域经济组织成员身份重叠现象之路径。结合不同学者的主张以及其他地区一体化组织的成功经验,非洲可通过下列方式消解该现象:严格根据地理位置划分作为加入区域经济组织的标准;加强区域经济组织司法机构的强制性和执行性规定,确保共同体法得到切实履行;完善共同体创立条约以及各成员国国内宪法有关共同体法的优先效力的规定,减少法律适用上的冲突。As the pillar of the realization of the African Economic Community,African regional economic communities play an important role in the process of African integration,but many regional economic communities in Africa lack effective coordination and integration,and the overlapping membership status may easily lead to the institutional overlap and conflicts.However,this important issue has been ignored for a long time.The phenomenon of the overlapping membership plays a positive role in the development of economic integration for some member states,but more attention should be paid to its negative effects.The negative influence is particularly prominent in hindering regional economic integration,especially bringing about many problems such as jurisdictional conflicts,overlapping obligations and conflicts in the application of laws.At present,it is very urgent for African countries to explore the ways to overcome the overlapping membership.To avoid the adverse effects of overlapping membership,the author suggests that one-country-one-membership system should be adopted;legal reform should be carried out in African countries;the supremacy of community laws should be clarified in the domestic laws of members states,so as to avoid exacerbating conflicts in the application of laws.
