论户外运动组织者身份认定及其侵权责任划分

摘　　要：侵权法视角对户外运动的召集者和组织者进行了定义,研究认为召集者不应承担队友的人身损害赔偿责任,而组织者则需根据其安全保障义务履行情况及活动是否为盈利性质承担不同的人身损害赔偿责任。建议加快我国户外运动立法进度,以法律形式规定运动组织者的安全防护责任和救助责任,并明确各种人身损害类型下组织者的赔偿范围。The paper defines the summons and organizers of outdoor sports from the perspective of tort law and holds that the summoners should not bear the personal injury liability of teammates,while the organizers should bear different liability for personal injury according to the performance of th&r safety and security obligations and whether the activities are profitable or not.It proposes to speed up the legislative progress of outdoor sports in our country,stipulate the responsibility of safety protection and rescue of sports organizers in the form of law and clarify the scope of compensation for organizers under various types of personal injury.
