区块链技术冲击下版权集体管理的发展之路

摘　　要：区块链技术在全球版权管理领域得到迅速发展,其在提升版权保护能力、促进版权管理的科学性以及加强版权管理市场主体选择权和市场秩序的保障等方面具有积极作用。与此同时,其"去中心化"对现有版权集体管理的集体性、垄断性和操作性都产生根本性冲击。尽管如此,版权集体管理仍有自身独立的价值所在。基于此,版权集体管理的未来发展应考虑与区块链技术结成愈来愈紧密的伙伴关系,在利用区块链技术完善自身的同时,也强化区块链技术无法实现的特殊功能,并创新和变革版权集体管理组织的经济职能和社会文化职能。Blockchain technology has been rapidly developed in the field of global copyright management. It has played an active role in improving copyright protection capabilities,promoting the scientific development of copyright management,and strengthening the rights of market participants in the rights management and market order protection. Simultaneously, "Decentralization" of blockchain technology impacts deeply the collective,monopolistic,and operational nature of the existing copyright collective management. Despite this,the independent value of copyright collective management still exists. Therefore,the future development of copyright collective management should consider forming an increasingly closer partnership with blockchain technology,not only improving itself by blockchain technology,but also strengthening its special functions that blockchain technology cannot achieve,and innovating economic,social and cultural functions of Copyright Collective Management Organizations.
