摘　　要：本文是判定技术方案是否落入专利权的保护范围的经验分享,对我国现行判定是否落入专利权的保护范围规则进行了梳理,并对所梳理出的规则如何理解运用进行了解释说明。其中,首先是对适用最广的规则的解释说明,然后是对各个特殊条件下才需遵循的判定规则的解释说明。而针对每个规则,首先是对该规则适用条件的解释说明,然后是对每个规则如何适用的解释说明。本文力争涵盖是否落入专利权的保护范围判定的所有情况,同时对各个容易出错的情况进行了详细解释说明。This article is an empirical sharing of judging a technical solution falls within the protection scope of a patent.A review of the current rules for the protection of patent rights in China is combed,and then an explanation of how the rules are understood and utilized is explained.The first is an explanation of the most widely applicable rules,followed by an explanation of the rules should be followed under each special condition.For each rule,the first explanation is the explanation of the applicable conditions of the rule,and then the explanation of how each rule applies.The paper tries to cover all the circumstances about the judgement concerning the protection scope of patent rights,and explain the various error-prone situations in detail.
