摘　　要：本案确立了以下裁判规则:地理标志证明商标申请人没有主动全面说明标志产区范围争议的,应依据2001年《商标法》第四十一条第一款规定的“以欺骗手段或者其他不正当手段取得注册的”条款判定其商标无效。This case establishes the following rules of adjudication:according to Article 41.1 of the Trademark Law 2001,i.e.the registration of the trademark was acquired by fraud or any other unfair means,if the applicant haven't disclosed the controversy on coverage of production areas,the geographical indication certification trademark should be judged invalid.
