承包商视角下工程变更费用索赔的障碍分析及对策研究

摘　　要：工程变更是工程建设中常见的行为,承包商在工程变更后的费用索赔是比原合同的约定尽了更多的义务而向业主提出给予经济补偿的行为,是合法合理的权利或者要求。但承包商因为业主或者自身的一些原因导致在变更之后索赔难的困境。本文首先介绍了工程变更费用索赔的定义和流程,并在此基础上提出工程变更费用索赔的原则;然后分析了承包商工程变更费用索赔的阻碍因素,最后对加强承包商工程变更费用索赔管理提出相应的建议。Engineering alteration is a common behavior in engineering construction.Contractor's claim for cost after engineering alteration is an act of offering economic compensation to the owner,which is a legitimate and reasonable right or requirement.However,the contractor is in a difficult position to claim after the change because of the owner or some of his own reasons.Firstly,this paper introduces the definition and process of engineering alteration cost claim,and on this basis,puts forward the principle of engineering alteration cost claim.Then,it analyses the obstacles of contractor's engineering alteration cost claim,and finally puts forward corresponding suggestions to strengthen contractor's engineering alteration cost claim management.
