摘　　要：疫情披露,关乎民众安危与社会稳定。医务人员作为较早接触疫情的群体,须向公权力部门履行疫情信息报告义务、向患方及其他医务人员履行告知义务,同时还享有向一定范围内不知情者披露疫情信息的权利。无论基于法定义务的驱动,还是基于法定权利的享有,医务人员均享有一定的疫情信息披露权。该披露权,不仅是法律父爱主义的体现,也是医疗父爱主义在法律父爱主义中获得尊重的一种体现。医务人员疫情信息披露权的行使,具有充分的法律依据。The outbreak disclosure is related to the public safety and social stability.As a group that has been exposed to the epidemic situation earlier,medical personnel shall fulfill the obligation of reporting the epidemic situation information to the department of public power,perform the obligation of informing patients and other medical personnel.At the same time,they shall also enjoy the right to disclose the epidemic situation information to the uninformed persons within a certain scope.Whether driven by legal obligations or enjoying legal rights,medical personnel have the right to disclose epidemic information.The disclosure right is not only the embodiment of legal paternalism,but also the embodiment of the respect of medical paternalism in legal paternalism.The exercise of the right of medical personnel to disclose epidemic information has sufficient legal basis.
