欧洲中世纪自然法思想视域下法律信仰命题反思

摘　　要：在欧洲中世纪自然法思想发展历程中,意志主义与理智主义两条进路循环交替,无论基于哪种立场,都不能有效证成法律信仰的命题。按照意志主义自然法的思考进路,法律信仰为对上帝的宗教信仰所吸纳,并没有纯粹法律信仰的存在空间。基于理智主义的自然法思想脉络,法律信仰命题可以在一定程度上被证成,但在根本上无法克服哲学与神学、世俗生活与宗教生活之间的内在永恒张力。During the development of natural thoughts in the Middle Ages,there existed two main theories of voluntarism and intellectualism.No matter based on which point of view,the proposition of legal belief cannot be proved effectively.According to the theory of volitional natural law,legal belief is absorbed by the religious belief in God,denying the existence of pure legal belief.In the thought of natural law which based on intellectualism,the proposition of legal belief can be proved to some extent,but it is incapable of overcoming the internal tensions between philosophy and theology,secular life and religious life fundamentally.
