摘 要:海洋强国背景下,为了促进船员行业的发展,船员的各项权益都应当加强保护,遣返权关乎到船员的生存问题,更应当格外重视。正值《海商法》修改之际,建议统一船员遣返相关的规定,将“遣返权”纳入《海商法》;遣返权条文设计的基本价值取向应该在平衡劳资之间的权益基础上,凸显对船员的倾向性保护;条文框架设计考虑全面履行《2006年海事劳工公约》的需要;明确确定遣返权是一项法定权利,具体规定遣返权的适用前提及内容。In order to promote the development of the crew industry,the rights and interests of the crew should be strengthened in the context of marine power strategy.As a survival-related issue,the right of repatriation ought to be especially our concern.At the time of the revision of the Maritime Code,we propose to unify the provisions related to the repatriation of crew members and write the"repatriation right"into the Maritime Code.The basic value of the provisions about repatriation right in Maritime Code should give priority to the protection of crews'interests based on balancing the industrial relations.In general,the framework design considers the need to fully implement the Maritime Labour Convention,2006.As for details,the repatriation right is clearly defined as a statutory right which clarifies the applicable premise and specific content of the repatriation right.
