刍议创新高校教师合法权益法制保障体系的必要性

摘　　要：高等教育是一个国家持续健康发展的核心动力,世界各国都对高等教育进行高度的关注,对于高校教师的各种法律体制的改革也在逐渐深入,因此高校教师的权益保护也越来越受到学者甚至社会的高度重视。而我国对于高校教师的权益保护问题是从20世纪90年代末期才开始不断深入研究的,而且是随着教师聘任制全面实行后才开始大规模开展的。本文表述了高校教师在现代法律框架下权益的保障制度,从两个不同的方面论述创新法制体系在高校教师权益保障中的必要性:第一,法律地位决定了维护高校教师合法权益的必要性;第二,当下的教育环境也突显了创新高校教师合法权益保障体系的必要性。Higher education is the core driving force for the sustainable and healthy development of a country.Countries around the world have paid great attention to higher education,and the reform of various legal systems for college teachers has gradually deepened.Therefore,the protection of the rights and interests of college teachers has been attached to more and more importance by scholars and even the society.The protection of the rights and interests of college teachers in China has been continuously researched since the late 1990s,and it has only been carried out on a large scale when the teacher appointment system has been fully implemented.This paper describes the guarantee system for the rights and interests of college teachers under the modern legal framework,and discusses the necessity of innovating the legal system for protecting the rights and interests of college teachers in two different aspects.First,the legal status determines the need to maintain the legitimate rights and interests of college teachers.Second,the current educational environment highlights the need to innovate the legal guarantee system for the legal rights and interests of college teachers.
