细谈“司法制造争议”——以张某网搜公民个人信息出卖案为例

摘　　要：纷繁复杂的社会决定了创造一个完全没有争议、没有问题的法治社会只是一种柏拉图式幻想,有问题并不可怕,可怕的是这些问题已经肆意疯长,而我们的法律执行者却仍熟视无睹,或安然自得。“司法制造争议”不是个案,而是整个司法环境普通存在的现象。它的危害可能不像生死重症一样要人性命,但是它却如同付骨之疽,无时无刻吸食破坏着国家、社会、人民的最纯正的法治期盼。而欲解决这个问题,应当从源头上清理故旧残缺的司法观念,从罪刑法定的根本整顿立法、司法以及执法,这是恪守刑事法治的应有之意。The complex society decided to create a completely uncontroversial,no problems of the rule of law society is a Platonic fantasy.The problem is not terrible,the terrible is that these problems have been rampant,and our law enforcers are still blind.Or comfortable."Judicial controversy"is not a case,but a common phenomenon in the entire judicial environment.Its harm may not be as serious as life and death,but it is like the gangrene of the bone,and it is constantly consuming and destroying the purest legal expectations of the country,society,and people.In order to solve this problem,we should clean up the old incomplete judicial concept from the source,and rectify the legislation,justice,and law enforcement from the legal basis of crime and punishment.This is the proper meaning of abiding by the criminal rule of law.
