公安禁毒执法风险的衍生逻辑及责任控制——基于风险社会视域

摘　　要：毒品治理是社会治理的重要环节,公安禁毒执法在毒品治理中发挥着不可替代的作用,但执法中也产生了较多的问题。执法风险的不确定性与复杂性,对公安禁毒执法能力转变带来了较大冲击。通过对风险社会理论的解释框架转换研究视角,对公安禁毒执法风险的外延与内涵进行解读,在厘清内部风险、外部风险、法律风险源基础上,探究禁毒执法风险衍生逻辑,利用道德伦理工具、管理工具、法律工具对风险进行责任控制,回归对“执法安全”与“执法风险”议题的学术探讨。Drug control is an important part of social governance.Drug law enforcement of the public security authorities plays an irreplaceable role as an important link in drug control,but there are also many problems in law enforcement process itself.The uncertainty and complexity of law enforcement risks have brought a big impact on the transformation of public security drug law enforcement capabilities.This paper applies the interpretative framework of the risk society theory to interpret the extension and connotation of the public security drug law enforcement risk.On the basis of clarifying internal risks,external risks,and legal risks,the derivativelogic of drug law enforcement risk is fully explored.Legal tools,management tools,and ethical tools are also applied to control risks and return to academic discussions on issues such as“enforcement security”and“enforcement risks”.
