摘　　要：以请求权基础分析方法为中心,在反思我国目前民商事案件裁判方法不足的同时,结合我国司法实践与审判实际,厘清了请求权基础分析方法中居于总论重要地位的三大基本问题,即统合法律逻辑与实践理性、兼顾正式与非正式法源、统一请求权与抗辩权的适用,并以上述总论为引导,从纳入审理的请求权范围、法律规范体系化类型化的检索、要件事实和完全性法条的确立、裁判结论妥当性的检讨四个具体方面,论述请求权基础分析方法在司法实践中的具体应用方法,以期对我国现有的民商事案件裁判方法有所增益。Based on the analysis approach to claim basis, combining with the judicial practice in China, this paper not only reflects on the insufficiency of the current adjudicative methods of civil and commercial cases in China, but also clarifies three basic issues which play an important role in general theory, that is, to integrate the legal logic and practice rationality, to consider both formal and informal sources of law, and to unify the application of the right of claim and its defense. Guided by the above general theory, this paper discusses the application of the analysis method of claim basis in judicial practice from four specific aspects, including the scope of basis of claim, the systematic and categorized retrieval of legal norms, the establishment of the essential facts and the completeness statutes, and the review of the appropriateness of the adjudication conclusion, so as to improve the existing adjudicative methods of civil and commercial cases in China.
