当代中国政治生态的修复、重建与养护——一个法学视角的观察与思考

摘　　要：因政治腐败导致政治生态恶化使当代中国面临着极其繁重的政治生态修复、重建和养护就是我们当前的重要任务。全面贯彻落实充分体现现代政治文明基本精神的公私观、主仆观、权利观、职责观的同时,厉行法治、实行民主和尊崇践行宪法,乃是政治生态修复、重建与养护的根本举措。坚持政治生态修复与重建并重而以养护为核心与重点、中国共产党党内政治生态建设与党外政治生态建设有机结合、突出重点与综合施治协调、制度要素完善与精神要素培育并举、依党规党纪正风肃纪与依宪法法律制裁违法犯罪相统一、以上率下与上下联动相配合、抓住“关键少数”与依靠全党参与并重、规范引领与监督追责协调、短期实效与长期实效兼顾、党的优良传统守正与改革创新互彰,这些乃是当代中国政治生态修复、重建与养护基本的实践策略。The worsening of the political ecological condition in China today as a result of political corruption renders it a primary task for China to repair,rebuild,and conserve the political ecology for the moment.To do so,it’s imperative to implement the ideas of the public and private,subjective and servant,right and duty,and obligation comprehensively and adequately,and at the same time to complement the rule of law,democracy,and respect for and practice of the Constitution.In practice,the following tactics should be adopted:treat the repairing and rebuildingof political ecology equally with an emphasis on the conserving,coordinate the internal and external political ecologies of the CPC,balance the relations between key elements and comprehensive factors,the institutional optimization and spirit cultivation,separate the political disciplines according to the CPC regulations from the illegal and criminal punishments according to the Constitution and laws,unite the elite and ordinary people withthe officials setting good examples,stress the key minority and the participation of all CPC members,emphasizethe combination of guidance,supervision and responsibility claiming,consider the relations between the short-term and long-term effects,traditions and reformand innovation.
